California Court of Appeal

Wanke, Indus., Commercial, Residential, Inc. v. Superior Court of San Diego, D058825

Plaintiff's writ petition seeking review of an order acquitting defendants of contempt for violating a stipulated injunction enjoining them from soliciting certain plaintiff's customers, is denied where the double jeopardy clause precludes the retrial of defendants on the contempt charges. However, the trial court's judgment is reversed as to the denial of plaintiff's motion to enforce a settlement agreement that incorporated the stipulated injunction because the court erred in finding that the stipulated injunction is invalid and refusing to enforce the injunction on that basis.
