Batarse v. Serv. Employees Int'l Union Local 1000, F062063
In plaintiff's suit against his employer for various causes of action, including racial and gender discrimination and wrongful termination in violation of public policy, trial court's grant of summary judgment in favor of the employer is affirmed where: 1) the trial court did not abuse its discretion in denying plaintiff's motion for a continuance; and 2) plaintiff has not established that any prejudice arising from the denial of an opportunity to correct the defective separate statement, because the facts outlined and the evidence cited by plaintiff in his opposition did not raise a triable issue of material fact sufficient to defeat defendant's motion for summary judgment.
