In a conviction of defendants for various offenses in connection with their operation of a nonprofit group home child care facility, the judgment of the trial court is reversed and remanded where: 1) there was probable cause to hold defendants to answer for the misappropriations of public funds counts, because based on the evidence before the grand jury, defendants are "persons charged with receipt, safekeeping, transfer, or disbursement of public moneys" within the meaning of Penal Code sections 424 and 426; and 2) the trial court erred in dismissing the four identity theft counts.
