California Court of Appeal
People v. Wooten, C067180
In a conviction of a defendant for various crimes, including rape and attempted murder, trial court's imposition of a great bodily injury enhancement pursuant to section 12022.8 on the forcible oral copulation offense, and a great bodily injury enhancement pursuant to section 12022.7(a) on the attempted murder offense is affirmed where: 1) defendant's argument that he engaged in a single, indivisible attack on the victim is rejected, because neither section 654 nor Ahmed applies to stay sentence enhancements imposed for offenses arising out of separate criminal acts; but 2) the abstract of judgment should be amended to reflect more clearly the sentences imposed by the trial court on remand.
