In a conviction of defendant for possessing cocaine and driving under the influence of alcohol, trial court's denial of defendant's motion to be reinstated in a section 1000 drug treatment program in order to satisfy the deferred entry of judgment requirements is affirmed where: 1) although the trial court misinterpreted section 1000(a)(3), the court properly terminated defendant's deferred entry of judgment under 1000.3 for unsatisfactory performance in the assigned drug treatment program; and 2) defendant's contention that he must be given an opportunity to withdraw his guilty plea will not be addressed because he was eligible for deferred entry of judgment in the first instance.
