Trial court's order recommitting defendant to the Department of Mental Health for one year as a mentally disordered offender is affirmed where: 1) the state hospital's Interdisciplinary Notes are not testimonial in nature, and thus the due process right of confrontation does not arise; 2) defendant's argument that the court erred by allowing the expert witnesses to usurp the jury's role is without merit; and 3) the court did not err in its jury instructions.
