In a bail forfeiture action, trial court's order denying a motion to vacate the forfeiture of a second bond is vacated and reversed where: 1) the defendant was not released from custody in exchange for the surety's appearance guarantee; and 2) the defendant did not have notice of the appearance date and time guaranteed by the second bond because he was not in actual custody when the second bond was posted.
