California Court of Appeal

People v. Luna, G045098

Sentence for his convictions for kidnapping, rape and aggravated assault, is affirmed where the trial court did not err by imposing an indeterminate sentence of 15 years to life under section 667.61(b), because section 667.61(e)(1) does not require a finding that the defendant kidnapped the victim with the intent to commit a sexual offense in order to impose the indeterminate, heightened sentence under section 667.61(b).
