California Court of Appeal
County of San Diego v. Mason, D060412
In a county's complaint filed against a defendant to establish paternity and to establish the amount of child support he was to pay the county on the child's behalf, the trial court's judgment of paternity based on defendant's failure to comply with an order to submit to a DNA paternity test at a county contracted laboratory, is affirmed where the trial court's order was proper because the defendant's privacy interests are protected by statute and the county has a compelling interest in selecting a laboratory to make an accurate paternity determination.
