R.H. v. Superior Court of San Diego County, D061609
A petition for writ review of juvenile court orders removing a child from her grandparents' home under Welfare and Institutions Code section 366.26, is denied where prospective adoptive parents have rights under section 366.26(n) to notice and the opportunity to object and to participate in the hearing, but they have no fundamental liberty interest in the child and no statutory or due process right to appointed counsel at the hearing. Further, the grandparents did not show there was any unfairness in the proceedings and they have not shown prejudice.
