People v. Calles, B225763

Defendant's convictions for vehicular manslaughter, leaving the scene of the accident, and second degree murder, are affirmed where the jury did not commit misconduct by using a watch to time a period in question to consider the events that could have taken place in that period. Sentence is reversed and remanded where the trial court erred in: 1) certain respects by staying execution of defendant's sentence on some counts; 2) enhancing defendant's sentence and failing to stay the execution of a sentence enhancement on certain counts; and 3) awarding defendant presentence conduct credits.
