In an action for damages and permanent injunction against a restaurant, claiming that the restaurant was not accessible in violation of the Americans with Disabilities Act and the Unruh Civil Rights Act, trial court's determination that it lacked subject-matter jurisdiction over the restaurant's qui tam cross complaint is affirmed in part, reversed in part and remanded where: 1) the trial court erred in determining that there was no triable issue of material fact on the public disclosure jurisdictional bar to defendant's qui tam cross complaint under the California False Claims Act, as there was no public disclosure of the information critical to defendant's claims; but 2) plaintiffs were entitled to summary adjudication on the conspiracy cause of action
