California Court of Appeal
Martin v. Van Bergen, B232570
In a quiet title action between two bordering property owners, trial court's judgment in favor of the plaintiffs is affirmed where: 1)e a boundary is not uncertain if it can be ascertained by an accurate survey; and 2) defendants cannot rely on the doctrine of boundary by agreement in defense of the action because evidence of an actual agreement does not exist.
