California Court of Appeal
Flores v. Lamps Plus, Inc., B220954
The trial court's order denying plaintiffs' motion for class certification of their labor claims is affirmed where: 1) consistent with the Supreme Court's resolution of the issue in Brinker, the trial court's legal analysis was correct in concluding that California law requires employers only to provide employees with meal and rest breaks, not to ensure the breaks are taken; and 2) substantial evidence demonstrates individualized inquiry of the plaintiffs' claim is necessary.
