California Court of Appeal

Muldrow v. Surrex Solutions Corp., D057955

In a class action suit against an employer claiming, inter alia, failure to pay overtime and failure to provide meal periods, trial court's judgment in favor of the employer is affirmed where: 1) the trial court did not err in determining that plaintiffs were not entitled to overtime pay because they were subject to the commissioned employees exemption; and 2) the trial court did not err in denying plaintiffs' missed meal period claim, as in Brinker, the Supreme Court held that an employer need only provide for meal periods, and need not ensure that employees take such breaks.
