Take Me Home Rescue v. Luri, B229486

In a breach of contract suit filed by an animal rescue organization against a foster caregiver for failure to spay a dog in her care, trial court's order issuing an injunction requiring defendant to return the rescue dog is affirmed, as because the terms of the parties' agreement establish that they had a partially integrated agreement that was supplemented by the collateral oral agreement that the foster dog must either be spayed or returned to plaintiff, plaintiff has a reasonable likelihood of success on the merits of its breach of contract claim, and the balancing of harms favors plaintiff in this case.
