California Court of Appeal
People v. Atencio, C063710
In a conviction of defendant for grand theft of a firearm and possession of a firearm by a felon, trial court's imposition of an aggregate prison term of 12 years and 4 months based on defendant's prior serious felony conviction and a prior strike and that he had served a prior prison sentence, is affirmed, but modified as defendant's sentence for the unlawful firearm possession conviction must be stayed pursuant to Penal Code section 654 because his two firearm offenses were incidental to only "one criminal intent and objective, namely to possess the firearm."
