Fahlen v. Sutter Cent. Valley Hospitals, F063023
In a plaintiff's whistleblower lawsuit pursuant to Health and Safety Code section 1278.5 against a hospital for refusing to renew his staff privileges, trial court's judgment is affirmed in part, reversed in part and remanded where: 1) prior filing of writ of proceedings is not required before pursuing a whistleblower lawsuit under section 1278.5; but 2) the exhaustion of judicial remedies doctrine does apply to remaining common law and statutory causes of action under the anti-SLAPP statute.
