In a suit for defamation and libel per se, trial court's denial of a motion to dismiss under the anti-SLAPP statute is affirmed, as assuming the accusations in defendant's newsletter to the homeowner's association constitute an exercise of free speech within the meaning of section 425.16(e)(3) or (e)(4), plaintiff has carried her burden of showing a probability of prevailing in the action.
