Maxim Crane Works, LP v. Tilbury Constructors, C067054
Following a judgment in favor of an injured employee in an underlying workplace lawsuit, trial court's judgment in favor of the employer in plaintiff's suit for breach of contract and indemnity is affirmed, as no California public policy is offended by the fact that plaintiff's contract gave it less protection, by virtue of plaintiff's choice of Pennsylvania law and its choice to deliver the crane the same day the contract was signed. Further, the trial court did not abuse its discretion in concluding the issues were "inextricably intertwined" and declining to lessen the employer's claimed fees by apportioning them as requested by the plaintiff.
