In plaintiffs' petition for an order directing payment out of the Department of Real Estate Recovery Account for an unsatisfied judgment in an underlying suit against their real estate broker and others, the trial court's decision, that two of the three remaining transactions involved a breach of fiduciary duty based on intentionally fraudulent misrepresentations and therefore must be paid from the Account, are fully supported by the record.
