Axis Surplus Ins. Co. v. Reinoso, B228332

In an insurance dispute, brought by the insurer, to recover its defense costs and settlement contribution in an underlying suit brought against its insured by her tenants of an apartment building that she co-owned with her husband, the judgment of the trial court is affirmed where: 1) there is substantial evidence to support a finding that the defendant was not covered by liability insurance in connection with claims brought by defendant's tenants; and 2) in connection with the insurer's action against the defendant and others to recover the costs of settling the claims in the underlying suit, there is substantial evidence to support the trial court's implied allocation to defendant of joint and several liability to the insurer for the amount of the settlement costs paid by the insurer.
