California Court of Appeal
People v. Rodriguez, B234642
Defendant's conviction for deterring, preventing, or resisting an officer by force and violence is affirmed, as contrary to defendant's argument that flight from an officer, standing alone, is not enough to support a finding of reasonable suspicion of criminal activity justifying a detention, defendant's flight coupled with a toss of an item during a police pursuit is suggestive of wrong doing and thus supports the reasonable suspicion requirement for a lawful detention.
