Wohlgemuth v. Caterpillar Inc., F061981

Following a settlement of plaintiffs' suit brought under the Song-Beverly Consumer Warranty Act, alleging that they purchased a motor home from the defendants with a defective engine and that the defendants failed to repair the defects after of reasonable number of attempts, trial court's judgment rejecting defendant's arguments that plaintiffs were not entitled to attorney fee and costs is affirmed, as plaintiffs' voluntary dismissal of the action pursuant to the compromise agreement did not preclude them from being the prevailing parties under section 1794(d).
