Aguilar v. Goldstein, B228435

In a shareholders' suit against the defendants, a provider of managerial and administrative staff to hospitals, claiming that defendants breached their fiduciary duty by putting their own interests ahead of the shareholders, the trial court's denial of defendants' special motion to strike under Code of Civil Procedure section 425.16 is affirmed as, defendants failed to make the threshold showing that plaintiffs' breach of fiduciary duty claim arises from protected activity.
