Robles v. Employment Development Department, A132773

In petitioner's application for unemployment compensation benefits after termination of his employment, the trial court's decision upholding administrative findings in denying plaintiff's petition for writ of administrative mandate is reversed as, the record does not show that petitioner was terminated because of misconduct within the meaning of Unemployment Insurance Code section 1256, and petitioner's employer did not overcome the statutory presumption that he was discharged for reasons other than misconduct.
