People v. Nishi, A129724

Conviction of defendant for attempting to deter or resist an executive officer in the performance of duty in violation of Penal Code section 68 is affirmed where: 1) the warrantless search of the defendant's campsite did not violate the Fourth Amendment as the defendant was not lawfully or legitimately on the premises where the search was conducted; and 2) the elements of a violation of section 69 are established by substantial evidence.
