In an action by a surety bond issuer challenging an award of attorney's fees under Vehicle Code section 11710, the award is affirmed where although the retail sales contract between respondent and a licensed dealer included an attorney fees provision, respondent did not sue dealer on that contract, but rather sued for fraud and therefore is entitled to attorney fees through his cause of action for violation of the Consumer Legal Remedies Act.
