California Court of Appeal

Rickards v. United Parcel Service, B234192

In a suit against UPS for violating the Fair Employment and Housing Act (FEHA), Gov. Code section 12900 et seq., the trial court's finding that plaintiff did not file a verified complaint with the Department of Fair Employment and Housing (DFEH) and thus failed to satisfy this jurisdictional prerequisite for filing a lawsuit under FEHA, is reversed where the complaint plaintiff's attorney filed through the DFEH online automated system was sufficient under FEHA. However, summary judgment to UPS is affirmed in the unpublished portion of the decision.
