People v. Mason, H036598
In an action challenging a $129.75 "criminal justice fee" the court ordered him to pay to the City of Sunnyvale pursuant to Government Code section 29550.1, the trial court's judgment is affirmed where: 1) imposing this fee without finding an ability to pay does not deprive defendant of the equal protection of the laws, because he is not similarly situated to the defendants to whom he compares himself, and a conceivable rational basis exists for treating him differently; and 2) the statute does not require a finding by the sentencing court of the actual costs in which the fee originated.
