California Court of Appeal
People v. Vargas, B231338
Conviction and Three Strikes re-sentence for burglary are affirmed where: 1) it was not an abuse of discretion to not dismiss one of the strike allegations solely because the case was remanded so the trial court could reconsider whether to dismiss one Three Strikes allegation because her two prior strike convictions arose from a single act; 2) the trial court did not abuse its discretion when considering all the circumstances of defendant's criminal history; and 3) her prison sentence was not unconstitutionally cruel or unusual.
