In an appeal brought by BART security officer who he shot and killed BART passenger Oscar Grant during a tense confrontation, conviction and sentence for involuntary manslaughter, Pen. Code section 192(b), are affirmed over claims of error including: 1) the evidence was insufficient regarding criminal negligence to support an involuntary manslaughter conviction; 2) the jury was improperly instructed; 3) the trial court erred by not granting a new trial due to newly discovered evidence; and 4) the trial court erred by denying probation.
