In a case in which a trial court denied a motion to dismiss for double jeopardy, the defendant's petition for a writ of prohibition is denied, where defense counsel participated in discussions which led the trial court to believe that counsel had consented to a procedure which ultimately resulted in the dismissal of the jury, prior to opening statements.
