In a suit by a former employee of the San Diego County Office of Education against several Education Office employees, alleging they retaliated against him in violation of Education Code section 44113(a) and seeking punitive damages and attorney's fees under section 44114(c), trial court's grant of summary judgment in favor of the defendants is reversed, where: 1) the trial court erred in determining section 44113(a) did not apply, since defendants might also have been supervisory employees under Government Code section 3540.1(m); but 2) the trial court correctly determined section 44114(c) did not apply to the plaintiff.
