California Court of Appeal
In re M.L., A132667
A juvenile court order dismissing a county social services agency's section 387 petition and placing a child with her grandparents is reversed, and an order requiring the agency to provide reunification services and transportation assistance is therefore set aside, where: 1) the juvenile court did not have the power to grant a criminal records exemption and exceeded its powers in placing the child with her grandparents; 2) the juvenile court's determination that the agency abused its discretion in denying an exemption did not authorize placement with the grandparents; and 3) the juvenile court should have granted the agency's motion to amend to conform to proof and granted the section 387 petition.
