California Court of Appeal
In re Jordan R., D059985
In dependency proceedings concerning two children of a man accused of sexually abusing a niece who was living in the family home: 1) orders adjudicating his daughter a dependent of the juvenile court are affirmed, where a) the juvenile court did not err in excluding expert testimony in the foundational hearing on the admissibility of the father's polygraph examination, and b) there was substantial evidence to support the finding that the daughter was at substantial risk of sexual abuse by her father; and 2) dismissal of the dependency petition filed on the son's behalf is affirmed, where the San Diego County Health and Human Services Agency did not meet its burden of proof to show that the son was at substantial risk of being sexually abused.
