California Court of Appeal

People v. Durant, A131004

Conviction for firearm possession by a felon is affirmed, as a motion to suppress was properly denied, where: 1) the officer who pulled over the defendant's vehicle for a traffic violation and then performed a patdown for weapons and found a loaded handgun in the defendant's waistband was aware, before the search, that the defendant was on probation and subject to warrantless search; and 2) any illegality in the traffic detention was attenuated by the defendant's probation search condition.
