California Court of Appeal

People ex rel. Trutanich v. Joseph, B232248

In a suit in which motions were brought by city attorneys on behalf of the state for permanent injunctive relief against the defendant's violations of the Narcotics Abatement Law, the Public Nuisance Law, and the Unfair Competition Law for selling marijuana out of a storefront, the trial court's grant of summary judgment to the plaintiff is affirmed, where: 1) the plaintiff met its initial burden of establishing a violation of those laws; 2) the defendant failed to present any admissible evidence sufficient to raise a triable issue of material fact or any defense; and 3) there was ample support in the record for the nature and scope of the injunctive relief granted by the trial court.
