California Court of Appeal
Medrazo v. Honda of North Hollywood, B230410
In a class action asserting claims under the Unfair Competition Law (UCL) and the Consumer Legal Remedies Act (CLRA), based upon a motorcycle dealer's alleged violations of Vehicle Code sections 11712.5 and 24014, the trial court's grant of the dealer's motion for judgment is: 1) reversed as to the UCL claim, where a) the plaintiff was required to establish her standing under the UCL, but b) she was not required to show actual reliance to establish such standing, and c) she presented sufficient evidence to establish standing under the "unlawful" prong of the UCL, and d) she had presented sufficient evidence of restitution amounts that could be owed; and 2) affirmed as to the CLRA claim, where she had forfeited any issues regarding that claim.
