California Court of Appeal

Peleg v. Neiman Marcus Group, Inc., B231634

In a suit against the plaintiff's former employer for violations of the Fair Employment and Housing Act, breach of an implied-in-fact contract requiring good cause for termination, wrongful termination in violation of public policy, and defamation, the trial court's grant of the defendant's motion to confirm an arbitration award is reversed, where: 1) a court could resolve the question of whether the parties' arbitration agreement was illusory; 2) the agreement's choice-of-law clause was valid; and 3) the arbitration contract was illusory under Texas law.
