Thornton v. California Unemployment Insurance Appeals Board, D058635

In a suit for reimbursement of the attorney fees and other expenses the plaintiff incurred in responding to investigations of the circumstances of her hiring as an administrative law judge for the Unemployment Insurance Appeals Board, the trial court's dismissal of the case is affirmed, where: 1) the plaintiff's claim failed under Government Code section 996.4, since the attorney fees and other expenses for which she sought reimbursement were incurred in responding to investigations of potential conflicts of interest in her hiring, not in the defense of a civil action or proceeding brought against her; and 2) Labor Code section 2802 has no application to public employees seeking reimbursement of defense costs from their employers.
