California Court of Appeal

Henry M. Lee Law Corp. v. Superior Court (Chang), B235305

In an employment compensation case in which the plaintiff's former attorney moved to intervene in the action and to amend a postjudgment order awarding attorney's fees to make the fee award payable directly to the firm, a peremptory writ of mandate is issued directing the trial court to vacate its order denying the motion, where: 1) the firm had standing to move to vacate the attorney's fee order, and extraordinary writ review of the denial of that motion was appropriate; 2) the trial court retained jurisdiction to rule on the motion; and 3) attorney's fees awarded under Labor Code sections 1194 and 226 are payable to the attorney, absent an agreement to the contrary.
