California Court of Appeal
People v. Baker, E053641
In a prisoner's challenge to a determination that she was a mentally disordered offender who was required to receive mental health treatment as a condition of parole, the determination is affirmed, where there was sufficient evidence that: 1) she had committed the qualifying offense of arson, based on a statement in the probation report that her brother had to be treated for smoke inhalation; and 2) she had received 90 days of treatment for her mental disorder in the year prior to her release date, based on an expert's testimony on this point, which although it was hearsay and not a proper subject for expert opinion testimony, was not objected to by the prisoner.
