In a prosecution for assault with a deadly weapon in which the issue of three-strikes sentencing was separately tried, the sentence as a three-striker is affirmed, where: 1) the trial court did not err in rejecting the appellant's argument that his convictions for mayhem and assault arose from the same criminal act and constituted a single strike; and 2) the appellant made no showing that the trial court abused its discretion in denying his Romero motion to strike one or both of the prior convictions.
