State Compensation Insurance Fund v. Workers' Compensation Appeals Board, B235258
In a case in which an employee who had been employed less than six months sought workers' compensation benefits for psychiatric injury in addition to physical injuries sustained after falling off a ladder while picking avocadoes, an order of the Workers' Compensation Appeal Board (WCAB) denying reconsideration of a ruling in favor of the applicant is annulled, and the matter is remanded to the WCAB with instructions to deny the claim for psychiatric injury, where the applicant's fall was not extraordinary within the meaning of an exemption to Labor Code section 3208.3(d)'s bar on claims of psychiatric injury to applicants employed less than six months.
