In an action asking the court to declare the rights and responsibilities of the City of Carpinteria and the plaintiff as parties to a stipulated judgment and to issue a writ of mandate reversing the city council's decision to deny a project for construction of a patio expansion on the plaintiff's beachfront property and instructing the city to issue a coastal development permit for the project, the trial court's denial of the petition is affirmed, where: 1) the plaintiff's failure to appeal the California Coastal Commission's denial of his claim for a vested rights exemption precluded that claim, and even so, no vested right was conferred by the stipulated judgment; and 2) substantial evidence supported denial of the development permit. .
