California Court of Appeal

People v. Tuck, A131624

The trial court's denial of a petition for a writ of mandate to set aside an order requiring him to register as a sex offender for life is affirmed, where: 1) Penal Code section 1385 does not give the trial court discretion to modify statutorily prescribed consequences of a conviction or to strike the registration requirement; and 2) mandatory registration for those who violate Penal Code section 288 by committing lewd acts on a child under the age of 14 does not deny equal protection.
