In a prosecution of a gang member for murder and other crimes, the court finds that: 1) the law of the case doctrine did not govern whether the defendant made a prima facie showing of violations of the Sixth Amendment and Fourteenth Amendment; 2) the defendant did not make a prima facie showing of violations of the Sixth and Fourteenth Amendments by introducing evidence of systematic exclusion of Hispanics and Asian-Americans from grand juries; and 3) the prosecution's rebuttal evidence was not flawed and sufficiently rebutted the prima facie showing.
