P G & E v. City and County of San Francisco, A127554

In litigation between PG&E and San Francisco over who could sell electricity to the Ferry Building after it was renovated, the trial court‘s denial of the city‘s and grant of PG&E's motion for summary adjudication of their claims for declaratory relief is affirmed, where: 1) the scope and magnitude of the postrenovation changes in the use of electricity at the Ferry Building amply supported the conclusion that the account was no longer "municipal load" that the city controlled under the parties' interconnection agreement; 2) there was a 100 percent material change in the building's use; and 3) there was no error in the scope of the declaratory relief granted by the trial court.
