Donkin v. Donkin, B228704

On trustees' appeal of a trial court order stating that trust beneficiaries' petition to compel a proper accounting and seeking other relief did not constitute a contest under the terms of the no-contest clauses of the trust, the order is affirmed to the extent that the trial court determined that the former law governing will contests and safe harbor petitions applied, but is otherwise reversed, where certain of the beneficiaries' challenges constituted a contest under the trust and its second amendment, while others required remand for a full determination in the trial court.
